1.1A bill for an act
1.2relating to education; conforming school food authority procurement cycle with
1.3the federal procurement cycle; clarifying contract terms for certain food service
1.4management contracts; amending Minnesota Statutes 2010, section 123B.52, by
1.5adding a subdivision.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 123B.52, is amended by adding a
1.8subdivision to read:
1.9    Subd. 1c. School food authority and food service management contracts.
1.10Notwithstanding the procurement cycle in subdivision 1, a school food authority contract
1.11with a food service management company must conform to the federal procurement cycle.
1.12The term of such contracts must not exceed one year with an option on the part of the
1.13district for yearly renewals for an additional four years.
1.14EFFECTIVE DATE.This section is effective the day following final enactment
1.15and applies to all new and renewal contracts.

1.16    Sec. 2. FOOD AND NUTRITION SERVICE CONTRACTS.
1.17(a) Notwithstanding Minnesota Statutes, section 123B.52, a school food authority
1.18that obtained a new food service management contract beginning in the 2008-2009 school
1.19year and has renewed twice, may renew for a third time for the school year 2011-2012 only.
1.20(b) Notwithstanding the original and renewal time requirements of Minnesota
1.21Statutes, section 123B.52, original and renewal contracts between a school food authority
1.22and a food service management company shall not exceed a total of four consecutive years.
2.1EFFECTIVE DATE.This section is effective for new and renewed food service
2.2contracts in the 2008-2009, 2009-2010, or 2010-2011 school year.
