1.1A bill for an act
1.2relating to capital investment; appropriating money for the city of St. Paul
1.3regional ballpark; authorizing the city to use design-build or construction
1.4manager at-risk method of project delivery; authorizing the sale and issuance of
1.5state bonds.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. CITY OF ST. PAUL REGIONAL BALLPARK.
1.8    Subdivision 1. Appropriation. (a) $27,000,000 is appropriated from the bond
1.9proceeds fund to the commissioner of employment and economic development for a grant
1.10to the city of St. Paul to prepare a site for and to predesign, design, construct, furnish,
1.11and equip a regional ballpark and related public infrastructure in the city of St. Paul. This
1.12appropriation is not available until the commissioner has determined that at least an equal
1.13amount has been committed to the project from nonstate sources.
1.14(b) The regional ballpark and related public infrastructure shall not be considered
1.15state bond financed property. This grant must be evidenced by a grant agreement that
1.16specifies how the general obligation grant will be used; the governmental program that
1.17will be operated; and that the program will be operated in compliance with this subdivision
1.18and all applicable state and federal laws and in a manner that will not cause the interest on
1.19the state general obligation bonds to be or become subject to federal income taxation for
1.20any reason. The grant agreement may contain other terms consistent with this subdivision
1.21and deemed appropriate by the commissioner of employment and economic development
1.22and the commissioner of management and budget.
1.23(c) The city may employ or contract with persons, firms, or corporations to perform
1.24one or more or all of the functions of architect, engineer, or construction manager with
2.1respect to all or any part of the regional ballpark and related public infrastructure. The
2.2city may deliver the project through either a design-build or construction manager at-risk
2.3method. Alternatively, at the request of a minor league baseball team, and with the consent
2.4of the city, the city may authorize the team to provide for the design and construction for
2.5the ballpark and related public infrastructure, subject to the terms of this subdivision. To
2.6the extent practicable and at the discretion of the city, the city may have such rights and
2.7exercise such powers, with respect to the acquisition, construction, use, and operation of
2.8the regional ballpark, as are granted to the Minnesota Ballpark Authority under Minnesota
2.9Statutes, section 473.756. No consent or approval of another political subdivision is
2.10required for the effectiveness or the exercise by the city of such rights or powers.
2.11    Subd. 2. Bond sale. To provide the money appropriated in this section from the
2.12bond proceeds fund, the commissioner of management and budget shall sell and issue
2.13bonds of the state in an amount up to $27,000,000 in the manner, upon the terms, and with
2.14the effect prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by the
2.15Minnesota Constitution, article XI, sections 4 to 7.
2.16EFFECTIVE DATE.This section is effective the day following final enactment.
