1.1A bill for an act
1.2relating to gambling; prohibiting class III gambling in Minnesota;repealing
1.3Minnesota Statutes 2010, section 3.9221.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. CLASS III GAMBLING PROHIBITED.
1.6Notwithstanding Minnesota Statutes, section 3.9221, or any other law to the
1.7contrary, class III gambling as defined in section 4 of the Indian Gaming Regulatory
1.8Act, Public Law 100-497, as amended, is unlawful and may not be conducted within the
1.9boundaries of the state of Minnesota. Any compacts negotiated under Minnesota Statutes,
1.10section 3.9221, for class III gambling, are declared null and void. For purposes of this
1.11section, "class III gambling" does not include on-track parimutuel betting on horse racing
1.12authorized by the Minnesota Constitution, article X, section 8, or a lottery operated by the
1.13state, authorized by the Minnesota Constitution, article XIII, section 5.

1.14    Sec. 2. REPEALER.
1.15Minnesota Statutes 2010, section 3.9221, is repealed.

1.16    Sec. 3. EFFECTIVE DATE.
1.17This act is effective the day following final enactment.
