1.1A bill for an act
1.2relating to education; prohibiting four-day week plans for school calendars;
1.3amending Minnesota Statutes 2010, sections 124D.10, subdivision 13; 124D.12;
1.4124D.126, subdivision 2.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 124D.10, subdivision 13, is amended to
1.7read:
1.8    Subd. 13. Length of school year. A charter school must provide instruction
1.9each year for at least the number of days required by section 120A.41. It may provide
1.10instruction throughout the year according to sections 124D.12 to 124D.127 or 124D.128.
1.11A charter school must not implement a four-day week plan, if the charter school did not
1.12use a four-day week plan in the 2010-2011 school year. A charter school that used a
1.13four-day week plan in the 2010-2011 school year must not implement a four-day week
1.14plan in the 2014-2015 school year or later.

1.15    Sec. 2. Minnesota Statutes 2010, section 124D.12, is amended to read:
1.16124D.12 PURPOSE OF FLEXIBLE LEARNING YEAR PROGRAMS.
1.17Sections 124D.12 to 124D.127 authorize districts to evaluate, plan, and employ the
1.18use of flexible learning year programs. It is anticipated that the open selection of the type
1.19of flexible learning year operation from a variety of alternatives will allow each district
1.20seeking to utilize this concept to suitably fulfill the educational needs of its pupils. These
1.21alternatives must include, but not be limited to, various 45-15 plans, four-quarter plans,
1.22quinmester plans, extended learning year plans, and flexible all-year plans, and four-day
1.23week plans.

2.1    Sec. 3. Minnesota Statutes 2010, section 124D.126, subdivision 2, is amended to read:
2.2    Subd. 2. Limitations. (a) Sections 124D.12 to 124D.127 may not be construed
2.3to authorize the commissioner to require the establishment of a flexible learning year
2.4program in any district in which the board has not voted to establish, maintain, and
2.5operate such a program.
2.6(b) The commissioner must not approve four-day week plans under this section.
2.7Approval for four-day week plans initiated before July 1, 2011, expires July 1, 2014.
2.8EFFECTIVE DATE.This section is effective the day following final enactment.
