1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [609.5275] CRIMINAL POSSESSION OR SALE OF
1.7IDENTIFICATION DOCUMENTS.
1.8 Subdivision 1. Definition. As used in this section, "identification document" means
1.9any of the following documents issued by or purported to be issued by the United States
1.10government or any state or local government: a passport, an immigration visa, an alien
1.11registration card, an employment authorization document, a birth certificate, a Social
1.12Security number or card, a military identification card, an adoption decree, a marriage
1.13license, a driver's license, or a photo identification card.
1.14 Subd. 2. Crimes defined. Whoever knowingly does any of the following is guilty
1.15of a crime and may be sentenced as provided in subdivision 3:
1.16(1) possesses two or more identification documents without permission or lawful
1.17authority; or
1.18(2) sells or transfers two or more identification documents knowing that the recipient
1.19or recipients are not entitled to obtain or possess the identification documents.
1.20 Subd. 3. Penalties. A person who violates subdivision 2 may be sentenced as
1.21follows:
1.22(1) if the violation involves two identification documents, the person is guilty of a
1.23gross misdemeanor; and
2.1(2) if the violation involves three or more identification documents, the person is
2.2guilty of a felony and may be sentenced to imprisonment for not more than three years
2.3or to payment of a fine of not more than $5,000, or both.
2.4EFFECTIVE DATE.This section is effective August 1, 2011, and applies to crimes
2.5committed on or after that date.
