1.3requirements for certain trunk highway projects;amending Minnesota Statutes
1.42012, section 174.185, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 174.185, is amended by adding a
1.7subdivision to read:
1.8 Subd. 4. Pavement overlays. (a) For any trunk highway project or maintenance
1.9work that involves an overlay, if pavement material selection includes an evaluation of
1.10a pavement product having a thickness of 4-1/2 inches or less, the commissioner shall
1.11perform an equivalent evaluation of an alternative pavement product having a thickness of
1.12five inches or less.
1.13(b) The commissioner shall give reasonable consideration to selecting the alternative
1.14pavement product as the pavement material if it:
1.15(1) provides an increase in pavement design life by at least 25 percent compared to
1.16the other pavement product; and
1.17(2) increases the maintenance work cost or total project cost estimate by no more
1.18than 25 percent.
