1.1A bill for an act
1.2relating to government finance; authorizing temporary transfers from the
1.3metropolitan livable communities fund accounts and the right-of-way loan
1.4acquisition fund for transit operating deficits; modifying funding sources for
1.5metropolitan livable communities fund accounts;amending Minnesota Statutes
1.62010, section 473.254, subdivision 5.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.8    Section 1. Minnesota Statutes 2010, section 473.254, subdivision 5, is amended to read:
1.9    Subd. 5. Sources of funds. (a) The council shall credit to the local housing
1.10incentives account any revenues derived from municipalities under subdivision 4,
1.11paragraph (b), clause (1).
1.12(b) The council shall credit $1,000,000 of the proceeds of solid waste bonds issued
1.13by the council under Minnesota Statutes, section 473.831, before its repeal, to the local
1.14housing incentives account in the metropolitan livable communities fund. In 1998 and each
1.15year thereafter through 2011, the council shall credit $1,000,000 of the revenues generated
1.16by the levy authorized in section 473.249 to the local housing incentives account.
1.17(c) In 1997, and each year thereafter through 2011, the council shall transfer
1.18$500,000 from the livable communities demonstration account to the local housing
1.19incentives account. In 2012, and each year thereafter, the council shall transfer $1,500,000
1.20from the livable communities demonstration account to the local housing incentives
1.21account.

1.22    Sec. 2. METROPOLITAN LIVABLE COMMUNITIES FUND; TRANSFERS.
1.23    (a) Notwithstanding Minnesota Statutes, sections 473.25 to 473.255, or any other
1.24law, the Metropolitan Council may transfer to its transit operating budget in 2011, 2012,
2.1and 2013, up to 50 percent of the sum of balances in, revenues in, and amounts otherwise
2.2credited, transferred, or distributed to, each of the following accounts in 2011, 2012,
2.3and 2013:
2.4(1) the tax base revitalization account pursuant to Minnesota Statutes, section
2.5473.252;
2.6(2) the livable communities demonstration account pursuant to Minnesota Statutes,
2.7section 473.253; and
2.8(3) the local housing incentives account pursuant to Minnesota Statutes, section
2.9473.254.
2.10(b) The council may not transfer funds under this section that are committed to
2.11grant or loan awards made by the council.
2.12    (c) The council shall use any amounts transferred under this section to cover
2.13operating deficits for transit services provided or assisted by the council under Minnesota
2.14Statutes, sections 473.371 to 473.449. If the council transfers funds pursuant to this
2.15section, the council shall amend the annual distribution plan described in Minnesota
2.16Statutes, section 473.25, paragraph (d), and include information about the transfer in the
2.17annual report required under Minnesota Statutes, section 473.25, paragraph (e).

2.18    Sec. 3. RIGHT-OF-WAY ACQUISITION LOAN FUND; TRANSFERS.
2.19    (a) Notwithstanding Minnesota Statutes, section 473.167, or any other law, the
2.20Metropolitan Council may transfer to its transit operating budget in 2011, 2012, and
2.212013, up to 75 percent of the amounts levied and collected in 2011, 2012, and 2013 under
2.22Minnesota Statutes, section 473.167, subdivision 3. The council shall use the amounts
2.23transferred to cover operating deficits for transit services provided or assisted by the
2.24council under Minnesota Statutes, sections 473.371 to 473.449.
2.25(b) If the council transfers funds pursuant to this section, the council shall within
2.26two weeks notify the chairs and ranking minority members of the house of representatives
2.27and senate committees with jurisdiction over transportation policy and finance concerning
2.28the transfers.

2.29    Sec. 4. APPLICATION.
2.30Sections 1 to 3 apply in the counties of Anoka, Carver, Dakota, Hennepin, Ramsey,
2.31Scott, and Washington.

2.32    Sec. 5. EFFECTIVE DATE.
2.33Sections 1 to 3 are effective the day following final enactment.
