SENATE BILL No. 1230
March 17, 2010, Introduced by Senators KUIPERS, GILBERT, JELINEK, RICHARDVILLE, BISHOP, CASSIS, PAPPAGEORGE, HARDIMAN and BARCIA and referred to the Committee on Transportation.
A bill to provide for remittance of certain excise taxes to
this state; and to provide that those who remit the excise taxes be
held harmless from penalties.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. All federal excise taxes on gasoline sold or used in
this state and collected by producers in this state shall be
remitted to the treasury of this state by the producers that
collect these taxes.
Sec. 2. The treasury of this state shall not remit the
proceeds remitted under section 1 to the United States.
Sec. 3. All producers shall be held harmless from any
allegations of violations of any law of this state or the United
States, whether civil or criminal, as a result of any actions taken
to comply with this act.
Sec. 4. As used in this act, "producer" means a refiner,
compounder, blender, or dealer of gasoline selling exclusively to
producers of gasoline in addition to producers of gasoline.
