SENATE BILL NO. 1155

September 30, 2020, Introduced by Senators IRWIN, MOSS, CHANG, SANTANA and HOLLIER and referred to the Committee on Regulatory Reform.

A bill to create a marihuana business grant program; to provide for the powers and duties of certain state governmental officers and entities; and to provide for the promulgation of rules.

the people of the state of michigan enact:

Sec. 1. As used in this act:

(a) "Medical marihuana facilities licensing act" means the medical marihuana facilities licensing act, 2016 PA 281, MCL 333.27101 to 333.27801.

(b) "Marijuana regulatory agency" means the marijuana regulatory agency created under Executive Reorganization Order No. 2019-2, MCL 333.27001.

(c) "Michigan Regulation and Taxation of Marihuana Act" means the Michigan Regulation and Taxation of Marihuana Act, 2018 IL 1, MCL 333.27951 to 333.27967.

(d) "Minority" means an individual who is black, hispanic, oriental, eskimo, or an American Indian.

(e) "Minority-owned business" means a business of which more than 50% of the voting shares or interest is owned, controlled, and operated by individuals who are minorities and residents of this state and with respect to which more than 50% of the net profit or loss attributable to the business accrues to shareholders who are minorities.

(f) "Woman-owned business" means a business of which more than 50% of the voting shares or interest is owned, controlled, and operated by women who are residents of this state and with respect to which more than 50% of the net profit or loss attributable to the business accrues to shareholders who are women.

Sec. 3. (1) The marijuana regulatory agency shall create and operate a grant program to award money to minority-owned businesses and woman-owned businesses seeking licensure under the medical marihuana facilities licensing act or the Michigan Regulation and Taxation of Marihuana Act. The purpose of the program is to help minority-owned businesses and woman-owned businesses fulfill the financial and other requirements of licensure under the medical marihuana facilities licensing act or the Michigan Regulation and Taxation of Marihuana Act. The marijuana regulatory agency shall create and publish an application and application review process for the grant program.

(2) The marijuana regulatory agency may promulgate rules to implement this act pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.
