SENATE BILL NO. 1005

April 13, 2022, Introduced by Senator BARRETT and referred to the Committee on Health Policy and Human Services.

A bill to amend 1978 PA 368, entitled

"Public health code,"

by amending section 16294 (MCL 333.16294), as amended by 1993 PA 79, and by adding section 16247a.

the people of the state of michigan enact:

Sec. 16247a. (1) If a board or task force reinstates a suspended license under section 16247 and subsequently determines that the individual whose license was suspended failed to meet all of the requirements for reinstatement described in that section, the board or task force may retroactively reinstate the individual's license to the date that the license was first erroneously reinstated under section 16247 if the board or task force determines that both of the following requirements are met:

(a) During the time period of the erroneous reinstatement, the individual was otherwise considered to be holding a license in good standing.

(b) The individual should be permitted in the public interest and fairness to practice.

(2) If a board or task force retroactively reinstates an individual's license under subsection (1), the individual is not considered to be in violation of the part that regulates the scope of practice of that health profession during the time period of the retroactive reinstatement.

Sec. 16294. Except as provided in section 16215 and section 16247a, an individual who practices or holds himself or herself out as practicing a health profession regulated by this article without a license or registration or under a suspended, revoked, lapsed, void, or fraudulently obtained license or registration, or outside the provisions of a limited license or registration, or who uses as his or her own the license or registration of another person, is guilty of a felony.
