SENATE BILL No. 905

 

 

October 15, 2009, Introduced by Senators GEORGE and BIRKHOLZ and referred to the Committee on Families and Human Services.

 

 

 

     A bill to amend 1994 PA 203, entitled

 

"Foster care and adoption services act,"

 

(MCL 722.951 to 722.960) by adding section 4e.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 4e. (1) Before making a payment to a foster care family,

 

the department shall adjust that family foster care payment as

 

follows:

 

     (a) In a foster care home in which no individual residing in

 

that household smokes, the department shall pay to that foster care

 

home an additional 50 cents over the family foster care rate at the

 

time the payment is being made.

 

     (b) In a foster care home in which there is an individual

 

residing in that household who smokes, the department shall

 

subtract $0.50 from the family foster care rate at the time the

 

payment is being made.

 

     (2) This section does not apply to a family foster care

 

payment made to a foster family in which a foster parent is a

 

relative of the foster child. As used in this subsection,

 

"relative" means that term as defined in section 13a of chapter

 

XIIA of the probate code of 1939, 1939 PA 288, MCL 712A.13a.
