HOUSE SUBSTITUTE FOR

 

SENATE BILL NO. 902

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1961 PA 236, entitled

 

"Revised judicature act of 1961,"

 

by amending section 5070 (MCL 600.5070), as added by 2000 PA 419;

 

and to repeal acts and parts of acts.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 5070. (1) This chapter provides for and governs

 

arbitration in domestic relations matters. Arbitration proceedings

 

under this chapter are also governed by court rule except to the

 

extent those provisions are modified by the arbitration agreement

 

or this chapter. This chapter controls if there is a conflict

 

between this chapter and chapter 50 or between this chapter and the

 

uniform arbitration act.

 

     (2) This chapter does not apply to arbitration in a domestic

 


relations matter if, before the effective date of the amendatory

 

act that added this chapter, March 28, 2001, the court has entered

 

an order for arbitration and all the parties have executed the

 

arbitration agreement.

 

     Enacting section 1. Sections 5001 to 5035 of the revised

 

judicature act of 1961, 1961 PA 236, MCL 600.5001 to 600.5035, are

 

repealed effective July 1, 2013.

 

     Enacting section 2. This amendatory act takes effect July 1,

 

2013.

 

     Enacting section 3. This amendatory act does not take effect

 

unless Senate Bill No. 903 of the 96th Legislature is enacted into

 

law.
