SENATE BILL No. 892

 

 

January 11, 2012, Introduced by Senators JONES, BIEDA and KOWALL and referred to the Committee on Agriculture.

 

 

 

     A bill to amend 1919 PA 339, entitled

 

"Dog law of 1919,"

 

(MCL 287.261 to 287.290) by adding section 10a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 10a. (1) A person who operates a large-scale commercial

 

breeding kennel shall apply annually to the department for a large-

 

scale commercial breeding kennel license. In addition, the

 

applicant for a large-scale commercial breeding kennel license

 

shall pay an annual $500.00 site inspection fee to the department.

 

     (2) Before issuing a large-scale commercial breeding kennel

 

license, the department shall inspect the kennel to verify that the

 

kennel complies with all of the provisions concerning large-scale

 

commercial breeding kennels as provided in the puppy protection

 

act. The department may delegate the inspection required under this

 


subsection to a county animal control agency. If the department

 

delegates the inspection to a county animal control agency, the

 

department shall pay 80% of the site inspection fee to the county

 

animal control agency. Within 30 days after conducting the site

 

inspection, the county animal control agency shall report its

 

findings to the department.

 

     (3) A person who obtains a large-scale commercial breeding

 

kennel license under subsection (1) shall comply with all of the

 

provisions concerning large-scale commercial breeding kennels as

 

provided in the puppy protection act and shall ensure that each dog

 

or puppy that is 12 weeks of age or older and housed at the kennel

 

is vaccinated against rabies by a licensed veterinarian.

 

     (4) As used in this section:

 

     (a) "Department" means the department of agriculture and rural

 

development.

 

     (b) "Large-scale commercial breeding kennel" means a kennel

 

where more than 15 female intact dogs are housed for the purpose of

 

breeding.

 

     (c) "Licensed veterinarian" means a person licensed to

 

practice veterinary medicine under article 15 of the public health

 

code, 1978 PA 368, MCL 333.16101 to 333.18838.

 

     Enacting section 1. This amendatory act takes effect January

 

1, 2012.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. 891                                      

 

            of the 96th Legislature is enacted into law.
