February 15, 2022, Introduced by Senators THEIS, BUMSTEAD, DALEY, VICTORY, BARRETT, WOZNIAK, MCBROOM, NESBITT, JOHNSON, RUNESTAD, OUTMAN and LAUWERS and referred to the Committee on Transportation and Infrastructure.

A bill to amend 1949 PA 300, entitled

"Michigan vehicle code,"

(MCL 257.1 to 257.923) by adding section 612a.

the people of the state of michigan enact:

Sec. 612a. (1) A photographic traffic signal enforcement system must not be used to enforce section 612 or any local ordinance substantially corresponding to section 612. Any citation issued on the basis of a recorded image produced by a photographic traffic signal enforcement system in violation of this section is void.

(2) As used in this section:

(a) "Photographic traffic signal enforcement system" means a system that satisfies both of the following:

(i) Consists of a camera system and vehicle sensor installed to exclusively work in conjunction with a traffic control signal.

(ii) Is capable of producing at least 2 recorded images that depict the registration plate attached to the front or the rear of a motor vehicle that is not operated in compliance with the instructions of the traffic control signal.

(b) "Recorded image" means a photographic or digital image that depicts the front or the rear of a motor vehicle.
