SENATE BILL No. 830

 

 

November 10, 2011, Introduced by Senator JONES and referred to the Committee on Redistricting.

 

 

 

     A bill to amend 1961 PA 236, entitled

 

"Revised judicature act of 1961,"

 

by amending sections 8149 and 8151 (MCL 600.8149 and 600.8151),

 

section 8151 as amended by 2000 PA 38.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 8149. (1) The Except as provided in subsection (2), the

 

eighty-fourth district consists of the counties of Wexford and

 

Missaukee, is a district of the first class, and has 1 judge.

 

     (2) Beginning on the date on which a vacancy occurs in the

 

office of district judge in the eighty-fourth district or the

 

beginning date of the term for which the incumbent district judge

 

in the eighty-fourth district no longer seeks election or

 

reelection to that office, whichever is earlier, the eighty-fourth

 

district consists of the counties of Wexford and Missaukee and is a

 

district of the first class. Under section 810a, the probate judge

 

for the county of Wexford shall serve as judge of the eighty-fourth

 

district within the county of Wexford and the probate judge for the

 

county of Missaukee shall serve as judge of the eighty-fourth

 

district within the county of Missaukee.

 

     Sec. 8151. (1) Except as provided in subsection (2), the

 

eighty-sixth district consists of the counties of Grand Traverse

 

and Leelanau, is a district of the first class, and has 2 judges.

 

     (2) Effective March 26, 2000, the Except as provided in

 

subsection (2), the eighty-sixth district consists of the counties

 

of Grand Traverse, Antrim, and Leelanau, is a district of the first

 

class, and has 3 judges. Effective March 26, 2000, the additional

 

judgeship in this district shall be filled by the incumbent judge

 

of the eighty-seventh district residing in Antrim county with a

 

term ending January 1, 2001 who shall serve as a judge of the

 

eighty-sixth district for the balance of the term to which he or

 

she was elected or appointed.

 

     (2) Beginning on the earlier of the following dates, the

 

eighty-sixth district has 2 judges:

 

     (a) The date on which a vacancy occurs in the office of

 

district judge in the eighty-sixth district.

 

     (b) The beginning date of the term for which an incumbent

 

district judge in the eighty-sixth district no longer seeks

 

election or reelection to that office.
