SENATE BILL No. 625

 

 

September 8, 2011, Introduced by Senator ROCCA and referred to the Committee on Judiciary.

 

 

 

     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

(MCL 750.1 to 750.568) by adding section 145e.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 145e. (1) An individual who is responsible for the care

 

of a minor who knows that the minor has died shall, not more than

 

24 hours after the individual knows that the minor has died, report

 

the death to a police agency or other emergency service provider.

 

This subsection does not apply if either of the following applies:

 

     (a) The death occurred while the minor was under the care of

 

another person who is required by law to report the death.

 

     (b) The individual is unable to report the death as prescribed

 

in this subsection, if he or she immediately reports the death when

 

able to do so.

 


     (2) An individual who is responsible for the care of a child

 

who knows or has reason to know that the child is missing shall,

 

not more than 48 hours after the individual knows or has reason to

 

know that the child is missing, report that the child is missing to

 

a police agency. For purposes of this section, an individual has

 

reason to know the child is missing if the individual does not know

 

the location of the child and has not been in contact with the

 

child within a 48-hour period. This subsection does not apply if

 

either of the following applies:

 

     (a) The child goes missing while the child was under the care

 

of another person who is required by law to report the absence of

 

the child.

 

     (b) The individual is unable to report the child as missing as

 

prescribed in this subsection, if he or she immediately reports the

 

child as missing when able to do so.

 

     (3) The requirements for reporting the death of a minor under

 

subsection (1) or a missing child under subsection (2) are met if

 

the individual does 1 of the following:

 

     (a) Contacts a law enforcement agency by telephone and reports

 

the minor's death or reports the child as missing and provides his

 

or her own name and address to the law enforcement agency.

 

            (b) Reports to a law enforcement officer in person that the

 

minor has died or that the child is missing, as applicable.

 

     (4) A person who violates this section is guilty of a felony

 

punishable by imprisonment for not more than 2 years or a fine of

 

not more than $5,000.00, or both.

 

     (5) This section shall be known and may be cited as "Caylee

 


Anthony's law".

 

     (6) As used in this section:

 

     (a) "Child" means an individual less than 13 years of age.

 

     (b) "Minor" means an individual less than 18 years of age.
