A bill to amend 1939 PA 280, entitled
"The social welfare act,"
(MCL 400.1 to 400.119b) by adding sections 14k and 14l.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 14k. A retailer or merchant shall not buy or sell food
assistance benefits for cash or other items besides eligible food.
A retailer or merchant who violates this section is subject to a
fine of up to $5,000.00 for each offense. The provisions of this
section do not preclude prosecution or other action under any other
criminal or civil statute.
Sec. 14l. Subject to any requirements established in federal
statute, rule, or regulation, any person who has been found by a
state or federal court or administrative agency in a hearing under
this act to have intentionally sold any food that was purchased
using supplemental nutrition assistance program benefits shall be
ineligible for benefits for a period of time to be determined by
the department.
