AN ACT to make, supplement, and adjust appropriations for certain capital outlay projects, the legislature, and certain state departments and agencies for the fiscal year ending September 30, 2013; to provide for the expenditure of the appropriations; and to prescribe certain conditions for the appropriations.

PART 2

PROVISIONS CONCERNING APPROPRIATIONS

GENERAL SECTIONS

Sec. 201. In accordance with the provisions of section 30 of article IX of the state constitution of 1963, total state spending from state resources in this appropriation act for the fiscal year ending September 30, 2013 is $47,307,200.00. State appropriations paid to local units of government are $36,840,000.00 as follows:

Sec. 202. The appropriations authorized under this act are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.

MICHIGAN NATURAL RESOURCES TRUST FUND

Sec. 301. (1) The department of natural resources shall enter into agreements with local units of government for the purpose of administering the grants identified in part 1. Among other provisions, the agreements shall require that grant recipients agree to dedicate to public outdoor recreation uses in perpetuity the land acquired or developed; to replace lands converted or lost to other than public outdoor recreation use; and, for parcels acquired that are over 5 acres in size, to provide the state with a nonparticipating 1/6 minimum royalty interest in any acquired minerals that are retained by the grant recipient.

(2) The agreements under subsection (1) shall also provide that the full payments of grants shall be made only after proof of acquisition, or proof of completion of the development project, is submitted by the grant recipient and all costs are verified by the department of natural resources. This requirement may be waived by the department of natural resources.

Sec. 302. The appropriations in part 1 for capital outlay shall be carried forward at the end of the fiscal year consistent with the provisions of section 248 of the management and budget act, 1984 PA 431, MCL 18.1248.

LEGISLATURE

Sec. 351. The funds appropriated in part 1 for the legislative council shall be used for a contract with the council of state governments to continue its review of Michigan’s sentencing guidelines and practices, including, but not limited to, studying length of prison stay and parole board discretion.

DEPARTMENT OF NATURAL RESOURCES

Sec. 401. (1) The following state shares of capital outlay appropriations for the waterways boating program are hereby reduced by the amounts indicated and the funds lapsed for the purpose of redirecting resources to emergency dredging in part 1:

Local project authorizations:

(a) Arcadia, Manistee County, marina rehabilitation (total authorized cost reduced from $1,000,000 to $500,000; state share is reduced from $500,000 to $0; local share $500,000) (AY 2006/36048).

(b) Naubinway, Mackinac County, breakwater protection, dredging and engineering, phase II (total authorized cost is reduced from $1,800,000 to $300,000; state share is reduced from $1,710,000 to $210,000; local share $90,000) (AY 2011/36045).

(c) East Jordan, Charlevoix County, dock demolition and rehabilitation, grading and shoreline protection, concrete walkways, utility upgrades, lighting and landscaping (total authorized cost is reduced from $2,058,000 to $1,543,600; state share is reduced from $514,400 to $0; local share $1,543,600) (AY 2011/36052).

(d) Infrastructure improvements - local projects (total authorized cost is reduced from $480,000 to $72,100; state share is reduced from $480,000 to $72,100) (AY 2012/36034).

(e) Cedarville, Mackinac County, dredging, steel sheet piling, parking improvements, launch ramps, docks, updated electrical/utilities, service building (total authorized cost is reduced from $2,040,000 to $1,020,000; state share is reduced from $1,020,000 to $0; local share $1,020,000) (AY 2012/36055).

(f) Infrastructure improvements - local projects (total authorized cost is reduced from $737,000 to $0; state share is reduced from $737,000 to $0) (AY 2013/36034).

(g) Presque Isle, Marquette County, removal and reconstruction of boat launch, phase I (total authorized cost is reduced from $402,400 to $201,200; state share is reduced from $201,200 to $0; local share $201,200) (AY 2013/36057).

(h) Munising, Alger County, east breakwall extension, phase I (total authorized cost is reduced from $874,800 to $437,400; state share is reduced from $437,400 to $0; local share $437,400) (AY 2013/36058).

State project authorizations:

(i) South Higgins Lake, Roscommon County, new entrance, launch ramp, maneuver area, parking and traffic flow improvements (total authorized cost is reduced from $1,000,000 to $250,900; state share is reduced from $1,000,000 to $250,900) (AY 2012/32045).

(j) Infrastructure improvements - state projects (total authorized cost is reduced from $1,950,000 to $1,373,000; federal share $1,200,000; state share is reduced from $750,000 to $173,000) (AY 2012/37030).

(k) Land acquisition - acquire land for future boating access site development (total authorized cost is reduced from $400,000 to $0; state share is reduced from $400,000 to $0) (AY 2012/37037).

(l) Field initiatives - routine maintenance, paving, small-scale projects at state facilities (total authorized cost is reduced from $600,000 to $180,000; state share is reduced from $600,000 to $180,000) (AY 2012/37040).

(m) East Tawas, Iosco County, harbor renovation, dock replacements, dredging, fueling station, new electrical/utilities, phase I (total authorized cost reduced from $1,000,000 to $70,000; state share reduced from $1,000,000 to $70,000) (AY 2012/37046).

(n) State infrastructure improvement and land acquisition (total authorized cost is reduced from $2,091,400 to $1,746,700; federal share $1,300,000; state share is reduced from $791,400 to $446,700) (AY 2013/37030).

(2) Any funds lapsed pursuant to subsection (1) shall be returned to the funds from which originally appropriated and are available for reappropriation.

Sec. 402. The department of natural resources shall seek reimbursement from the United States army corps of engineers for costs related to the emergency dredging of harbors under the jurisdiction of the corps of engineers. If the corps of engineers reimburses the state for any costs incurred from the appropriation for emergency dredging, the federal revenue shall be deposited in the general fund and the Michigan state waterways fund in proportion to the overall expenditures for emergency dredging as authorized in this act.

Sec. 403. (1) From the amount appropriated in part 1 for emergency dredging, the department of natural resources shall fund the amounts estimated for the following projects:

(2) If any appropriation authority for emergency dredging remains after the completion of the projects listed in subsection (1), the department of natural resources may expend remaining funds for any allowable use for the Michigan state waterways fund. The department of natural resources shall notify the senate and house appropriations committees and the senate and house appropriations subcommittees on natural resources of any expenditures made under this subsection. The notification shall include a list of projects and their amounts as well as any other pertinent information.

DEPARTMENT OF MILITARY AND VETERANS AFFAIRS

Sec. 501. The Michigan veterans affairs agency shall submit a strategic plan to the senate and house standing committees on appropriations, the senate and house fiscal agencies, and the state budget office by October 1, 2013 that includes the following:

(a) A plan to serve as the coordinating office for all executive branch departments responsible for programs that provide services to veterans.

(b) A plan to identify opportunities to improve the provision of services to veterans by state agencies and to improve the oversight of grants to veterans service organizations.

(c) A plan to re-engineer the current veterans’ service delivery system in a manner that ensures the efficient and effective utilization and allocation of resources, programs, and services among state agencies, local government agencies, veterans service organizations, and nonprofit organizations.

(d) Quantifiable performance measures and outcomes of veterans service programs, with a goal of increasing veterans’ and the public’s awareness of services available to veterans and their families and increasing the number of verified fully-developed claims for veterans benefits submitted to the United States department of veterans affairs. Identified measures should include outcomes for programs affecting veterans education, health, economic, and quality of life well-being. These goals shall include, among other things, a goal of 100% of benefit claims presented to the United States department of veterans affairs shall be fully-developed.

(e) Immediate, short-term, and long-term initiatives that assist the agency in achieving the performance measures and outcomes identified in subdivision (d).

Sec. 502. The Michigan veterans affairs agency shall submit a report to the senate and house standing committees on appropriations, the senate and house fiscal agencies, and the state budget office by October 1, 2013 that includes the following:

(a) A description of the current programs, activities, roles and responsibilities of, and interrelationships among, state agencies, local government agencies, veterans service organizations, and other nonprofit organizations to provide services and outreach to veterans, including providing assistance with the preparation and presentation of claims for benefits to the United States department of veterans affairs.

(b) A description of the activities, roles and responsibilities of, and interrelationships among, state agencies, local government agencies, veterans service organizations, and other nonprofit organizations undertaken under the re-engineered veterans service delivery system identified in the strategic plan developed pursuant to section 501.

Sec. 503. The Michigan veterans affairs agency shall submit quarterly reports as provided in section 219 of article XII of 2012 PA 200 providing a summary of the agency’s activities, including data on the number of claims presented to the United States department of veterans affairs by the agency and the number of claims that are fully-developed.

DEPARTMENT OF TREASURY

Sec. 601. The funds appropriated in part 1 for the marina dredging loan origination program are considered work project appropriations, and any unencumbered or unallotted funds are carried forward into the succeeding fiscal year. The following is in compliance with section 451a(1) of the management and budget act, 1984 PA 431, MCL 18.1451a:

(a) The purpose of the project is to provide financial assistance to eligible marinas and to alleviate financial distress caused by low water levels impacting watercraft use and related economic impacts through the program.

(b) The work project will be accomplished through the use of payments to qualified financial institutions for marina dredging loan origination fees for administrative costs incurred by qualified financial institutions.

(c) The total estimated completion cost of the work project is $1,000,000.00.

(d) The tentative completion date is March 1, 2014.

This act is ordered to take immediate effect.
