A bill to amend 1954 PA 116, entitled
"Michigan election law,"
by amending section 933 (MCL 168.933), as amended by 2003 PA 119,
and by adding section 558a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 558a. (1) In addition to the requirements in section 558,
a candidate for elective office shall file an affidavit with the
officer with whom the affidavit of identity is filed under section
558 stating that the candidate has not been convicted within the
immediately preceding 20 years of a felony involving dishonesty,
deceit, fraud, or a breach of the public trust that was related to
the candidate's official capacity while holding an elective office
or position of employment in local, state, or federal government.
(2) The official responsible for preparing the ballot for use
in an election shall not include a candidate on a ballot unless the
candidate has filed the affidavit as required under this section.
Sec.
933. A person An
individual who makes a false affidavit
or swears falsely while under oath under section 848 or for the
purpose of securing registration, for the purpose of voting at an
election, or for the purpose of qualifying as a candidate for
elective office under section 558 or 558a is guilty of perjury
punishable as provided in section 936.
