HOUSE BILL NO. 6377

A bill to amend 1966 PA 293, entitled

"An act to provide for the establishment of charter counties; to provide for the election of charter commissioners; to prescribe their powers and duties; to prohibit certain acts of a county board of commissioners after the approval of the election of a charter commission; to prescribe the mandatory and permissive provisions of a charter; to provide for the exercise by a charter county of certain powers whether or not authorized by its charter; and to prescribe penalties and provide remedies,"

by amending sections 7 and 17 (MCL 45.507 and 45.517).

the people of the state of michigan enact:

Sec. 7. (1) Upon the passage of the resolution, the county clerk, within 3 business days, shall transmit a certified copy thereof of the resolution to the clerk of each city, village, and township in his or her county.

(2) The Before January 1, 2022, the county clerk shall publish a notice of election, and together with the proposition and office to be voted upon, in at least 1 newspaper having general circulation in the county. The Before January 1, 2022, the first publication shall must be not less than 10 days prior to before the election. The Before January 1, 2022, the county clerk shall also cause a notice of election, together with the proposition and office to be voted upon, to be posted in 2 or more conspicuous places in each precinct within the county. Upon Before January 1, 2022, upon the request of the county clerk, the posting shall must be done by the clerk of the local unit of government. Beginning January 1, 2022, the county clerk shall, not less than 10 days before the election, post notice of election, together with the proposition and office to be voted upon, as set forth in the local government public notice act.

Sec. 17. (1) Upon the passage of the resolution by the charter commission fixing the date for the submission and election, the county clerk, within 3 business days, shall transmit a certified copy of the resolution, together with a copy of the proposed charter, to the clerk of each city, village, and township within his or her county.

(2) The Before January 1, 2022, the county clerk shall cause the proposed charter to be published in at least 1 newspaper having general circulation within the county. The Before January 1, 2022, the charter shall must be published not less than 2 weeks nor or more than 4 weeks prior to before the election. Beginning January 1, 2022, the county clerk shall, not less than 2 weeks or more than 4 weeks before the election, post public notice of the proposed charter as set forth in the local government public notice act.

(3) The county clerk shall also cause to be published a notice of election in accordance with to be provided as set forth in section 7.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 6440 (request no. 02449'19) of the 100th Legislature is enacted into law.
