HOUSE BILL NO. 5947

A bill to amend 1992 PA 116, entitled

"Records reproduction act,"

(MCL 24.401 to 24.406) by adding section 2a.

the people of the state of michigan enact:

Sec. 2a. (1) A county, city, village, or township may reproduce in any electronic or digital file format an ordinance, an amendment to an ordinance, or the minutes of a meeting for that county, city, village, or township.

(2) If a county, city, village, or township reproduces an ordinance, an amendment to an ordinance, or the minutes of a meeting as provided in subsection (1), the original ordinance, amendment, or minutes may be disposed of or destroyed as authorized under section 11 of the Michigan history center act, 2016 PA 470, MCL 399.811.

(3) If a county, city, village, or township disposes of or destroys the original of an ordinance, an amendment to an ordinance, or the minutes of a meeting as provided in subsection (2), the clerk of that county, city, village, or township shall make the electronic or digital file format of that ordinance, that amendment, or those minutes available to the public in the clerk's office during normal business hours.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.

Enacting section 2. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 5948 (request no. 03965'19 a) of the 100th Legislature is enacted into law.
