A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
(MCL 600.101 to 600.9947) by adding section 2940a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 2940a. (1) An individual who resides within 1,000 feet of
a vacant dwelling may, without force, enter the vacant dwelling and
the property on which it is located for the purpose of securing the
dwelling against entry, controlling or preventing vermin, trimming
overgrown vegetation, removing garbage or rubbish, and taking other
measures intended to eliminate nuisance or potential nuisance
conditions unless expressly forbidden to do so by the owner or
lessee.
(2) An individual who proceeds under subsection (1) is liable
to the owner of the property entered for any resulting damages.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No.____ or House Bill No. 5744(request no.
03693'11 a) of the 96th Legislature is enacted into law.
