HOUSE BILL No. 5736

     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

(MCL 750.1 to 750.568) by adding section 141b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 141b. A person shall not sell or otherwise deliver any

 

amount of kratom to a minor. A person who violates this section is

 

guilty of a misdemeanor punishable by imprisonment for not more

 

than 93 days or a fine of not more than $100.00, or both. As used

 

in this section:

 

     (a) "Kratom" means all parts of the plant presently classified

 

botanically as Mitragyna speciosa, whether growing or not; the

 

leaves and seeds of that plant; any extract or resin from any part

 

of that plant; and every compound, salt, derivative, mixture, or

 

preparation of that plant or its leaves, seeds, or extracts.

 

     (b) "Minor" means an individual less than 18 years of age.
