HOUSE BILL NO. 5580

November 30, 2021, Introduced by Reps. Aiyash, Rogers, Hood, Neeley, Koleszar, Brixie, Scott, O'Neal, Thanedar, Cavanagh, Steckloff, Stone, Young, Hope, Tyrone Carter, Yancey, Peterson, Sowerby and Whitsett and referred to the Committee on Energy.

A bill to prescribe the powers and duties of certain water utilities; and to prescribe civil sanctions for certain violations of this act.

the people of the state of michigan enact:

Sec. 1. As used in this act, "water utility" means a person that provides water supply service or sewerage service.

Sec. 2. (1) By February 1, 2022, a water utility shall prepare a plan that does both of the following:

(a) Ensures that each permanently installed water pump or power source under that water utility's jurisdiction automatically switches to an alternative power source if the primary source of power fails.

(b) Ensures that an alternative power source under subdivision (a) is able to operate continuously for at least 72 hours.

(2) By October 1, 2023, each water utility shall fully implement the plan prepared in subsection (1).

Sec. 3. A water utility that violates this section is subject to a civil fine of $1,000.00 per day for each violation of this act.
