A bill to amend 1973 PA 116, entitled
"An act to provide for the protection of children through the
licensing and regulation of child care organizations; to provide
for the establishment of standards of care for child care
organizations; to prescribe powers and duties of certain
departments of this state and adoption facilitators; to provide
penalties; and to repeal acts and parts of acts,"
(MCL 722.111 to 722.128) by adding section 3h.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3h. (1) All child care centers, group child care homes,
and family child care homes that provide care for children under 1
year of age must implement and maintain a written safe sleep policy
that is in accordance with and incorporates applicable licensing
rules promulgated under this act.
(2) Licensees, registrants, and employees of child care
centers, group child care homes, and family child care homes must
review the safe sleep policy required in subsection (1) and sign an
acknowledgement that they understand that safe sleep practices are
to be used as described in the safe sleep policy.
(3) A child care center, group child care home, or family
child care home described in subsection (1) shall make its safe
sleep policy available on request from the parent or legal guardian
of a child in the child care center's, group child care home's, or
family child care home's care and shall make its safe sleep policy
available on its website, if it has a website.
(4) The department shall develop and provide to child care
centers, group child care homes, or family child care homes a
sample safe sleep policy based on generally accepted safe sleep
practices.
(5) The department may add additional requirements for safe
sleep policies through rule promulgation.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
