HOUSE BILL No. 5505
March 21, 2012, Introduced by Reps. Meadows, Bauer, Hammel, Dillon, Slavens, Greimel, Irwin and Cavanagh and referred to the Committee on Appropriations.
A bill to establish a program to designate, promote, and
market to public entities farm products that are grown, processed,
or manufactured in this state; and to prescribe the powers and
duties of certain state agencies and officials.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited as the "buy
Michigan first act".
Sec. 2. As used in this act:
(a) "Department" means the department of agriculture and rural
development.
(b) "Farm product" means that term as it is defined in section
2 of the right to farm act, 1981 PA 93, MCL 286.472.
Sec. 3. (1) The department shall establish a "Buy Michigan
First" program to clearly designate and encourage the purchase by
public entities of farm products grown, processed, or manufactured
in this state.
(2) The program established under subsection (1) shall be
designed to do at least all of the following:
(a) Increase opportunities to market to public entities farm
products that are grown, processed, or manufactured in this state.
(b) Enter into partnerships with other public institutions,
local governments, universities and colleges, commodity groups,
manufacturers, retailers, and other entities to assist in carrying
out the purpose of this act.
(c) Establish a procedure for applying for grants and
identifying other forms of funding to implement this act.
Sec. 4. As allowed by law, the department may provide for the
trademarking or protection of a "Buy Michigan First" logo and other
identifying marking. The department may design uniform point-of-
sale signage, stickers, posters, banners, and display cards as part
of the promotion of the sale of Michigan farm products.
Sec. 5. The department may accept funds from any private or
public source for implementation of this act.
Sec. 6. The department may promulgate rules under the
administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to
24.328, to implement this act.
