     A bill to make, supplement, and adjust appropriations for the

 

department of state police for the fiscal year ending September 30,

 

2014; and to provide for the expenditure of the appropriations.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

PART 2

 

PROVISIONS CONCERNING APPROPRIATIONS

 

GENERAL SECTIONS

 

     Sec. 201. In accordance with the provisions of section 30 of

 

article IX of the state constitution of 1963, total state spending

 

from state resources in this appropriation act for the fiscal year

 

ending September 30, 2014 is $10,000,000.00 and state

 

appropriations paid to local units of government are

 

$10,000,000.00.

 

     Sec. 202. The appropriations authorized under this act are

 

subject to the management and budget act, 1984 PA 431, MCL 18.1101

 

to 18.1594.

 

 

 

DEPARTMENT OF STATE POLICE

 

     Sec. 301. (1) The funds appropriated in part 1 for emergency

 

management – freeze damage shall be allocated in order to alleviate

 

the burden placed upon the municipalities and counties in the Upper

 

Peninsula experiencing damage to water mains, sewer lines, and

 

other public infrastructure due to the prolonged period of time in

 

which temperatures were below freezing and the resulting increase,

 


and subsequent thaw, of ground frost. Counties and municipalities

 

may apply for assistance grants to the department under this

 

section. Reimbursement for expenditures shall be limited to public

 

damage and direct loss as a result of the prolonged freeze. To be

 

eligible for grant assistance, applicants must meet the following

 

criteria:

 

     (a) Maintain an emergency management program or be

 

incorporated into a county emergency management program as provided

 

under the emergency management act, 1976 PA 390, MCL 30.401 to

 

30.421.

 

     (b) Implement the applicable emergency operations plan in a

 

timely manner before the disaster or emergency.

 

     (c) Certify the exhaustion of local effort, including the

 

utilization of all available and applicable disaster relief forces

 

as identified in the emergency operations plan.

 

     (d) Demonstrate a financial hardship.

 

     (e) Conduct an assessment of damages that are incurred in the

 

disaster or emergency and forward the assessment to the department

 

in accordance with standards and procedures established by the

 

department.

 

     (f) Declare a local state of emergency in a timely manner, as

 

provided under section 10 of the emergency management act, 1976 PA

 

390, MCL 30.410.

 

     (2) Any unexpended amounts appropriated for emergency

 

management – freeze damage are considered work project

 

appropriations and are available for expenditure in succeeding

 

fiscal years. The following is in compliance with section 451a(1)

 


of the management and budget act, 1984 PA 431, MCL 18.1451a:

 

     (a) The purpose of this project is to provide assistance to

 

municipalities and counties affected by damage resulting from the

 

prolonged freeze.

 

     (b) The project will be accomplished by state employees, local

 

employees, and contracts.

 

     (c) The total estimated cost of the project is $10,000,000.00.

 

     (d) The tentative completion date of the project is September

 

30, 2018.
