HOUSE BILL No. 5351

February 10, 2016, Introduced by Rep. Kosowski and referred to the Committee on Judiciary.

 

     A bill to create the school security task force; and to

 

prescribe the powers and duties of the school security task force.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the

 

"school security task force act".

 

     Sec. 3. As used in this act:

 

     (a) "School shooting incident" means a mass shooting event

 

involving an attack by an individual or individuals armed with

 

firearms on an educational institution in which the educational

 

institution is the location for the attack.

 

     (b) "Task force" means the school security task force created

 

in section 5.

     Sec. 5. (1) The school security task force is created within

 

the department of state police.

 

     (2) The governor shall appoint members to the task force in

 

consultation with the director of the department of state police.

 

The task force shall be made up of 5 individuals and shall include

 

the following:

 

     (a) The director of the department of state police.

 

     (b) The director of the department of military and veterans

 

affairs or his or her designee.

 

     (c) The director of the department of health and human

 

services or his or her designee.

 

     (d) Two individuals appointed by the governor.

 

     (3) The director of the department of state police shall serve

 

as the task force's presiding officer. The task force shall meet at

 

the call of the presiding officer.

 

     (4) The task force shall make recommendations for improving

 

school policies and procedures in response to school shooting

 

incidents in this state. In making those recommendations, the task

 

force shall do all of the following:

 

     (a) Gather information concerning school shooting incidents

 

throughout this state.

 

     (b) Receive reports and testimony from individuals, state and

 

local agencies, community-based organizations, and other public and

 

private organizations.

 

     (c) Review policies and procedures developed in other states

 

to improve the school response to school shooting incidents.

 

     (d) Create goals for school policies and procedures statewide

to prevent school shooting incidents.

 

     (e) Create recommendations and guidelines for school policies

 

and procedures for response to school shooting incidents.

 

     (f) Submit a report with the task force's recommendations to

 

the governor and the legislature not later than 180 days after the

 

members of the task force are appointed.

 

     (5) The task force shall consult with the state board of

 

education and any other state agency or department necessary to

 

accomplish the task force's responsibilities under this section.

 

     (6) The members of the task force shall serve without

 

compensation but may be reimbursed for actual and necessary

 

expenses.

 

     (7) The business that the board may perform shall be conducted

 

at a public meeting of the board held in compliance with the open

 

meetings act, 1976 PA 267, MCL 15.261 to 15.275.

 

     (8) A writing prepared, owned, used, in the possession of, or

 

retained by the board in the performance of an official function is

 

subject to the freedom of information act, 1976 PA 442, MCL 15.231

 

to 15.246.

 

     Enacting section 1. This act takes effect 90 days after the

 

date it is enacted into law.
