HOUSE BILL NO. 5109

A bill to amend 1979 PA 94, entitled

"The state school aid act of 1979,"

(MCL 388.1601 to 388.1896) by adding section 34.

the people of the state of michigan enact:

Sec. 34. (1) In addition to the appropriations in section 11, there is appropriated an amount not to exceed $10,000,000.00 from the state school aid fund for 2021-2022 for the purposes of this section. The department shall establish a program to distribute this funding to districts as described in subsection (3).

(2) To receive funding under this section, a district must apply for the funding in a form and manner prescribed by the department.

(3) Subject to subsection (5), the department shall distribute funding under this section as follows:

(a) If an applicant district establishes in its application submitted under this section that the average salary of all of the teachers employed by the district equals an amount that is at least 95% but less than 100% of the average salary of all individuals who are similarly educated and who reside in the prosperity region or subregion in which the district is located, the department shall pay that district $20.00 for each membership pupil in the district.

(b) If an applicant district establishes in its application submitted under this section that the average salary of all of the teachers employed by the district equals an amount that is at least 100% but less than 110% of the average salary of all individuals who are similarly educated and who reside in the prosperity region or subregion in which the district is located, the department shall pay that district $30.00 for each membership pupil in the district.

(c) If an applicant district establishes in its application submitted under this section that the average salary of all of the teachers employed by the district equals an amount that is at least 110% of the average salary of all individuals who are similarly educated and who reside in the prosperity region or subregion in which the district is located, the department shall pay that district $35.00 for each membership pupil in the district.

(4) Notwithstanding section 17b, the department shall make payments to districts under this section on a schedule determined by the department.

(5) If the department determines that a district qualifies for funding under more than 1 subdivision under subsection (3), the department shall only pay the district the funding it qualifies for under the subdivision that would yield the greatest payment to the district under subsection (3).

(6) If the appropriation under subsection (1) is insufficient to fully fund payments under subsection (3), the department shall prorate payments under this section on an equal per-pupil basis.

(7) As used in this section, "similarly educated" means an individual who has the same level of educational degree from a postsecondary institution.
