HOUSE BILL NO. 4916

July 18, 2023, Introduced by Reps. Martus, Fitzgerald, Weiss, Glanville, Hood, Farhat, Hoskins, Morgan, Steckloff and Snyder and referred to the Committee on Transportation, Mobility and Infrastructure.

A bill to amend 1993 PA 354, entitled

"Railroad code of 1993,"

(MCL 462.101 to 462.451) by adding section 352.

the people of the state of michigan enact:

Sec. 352. (1) Except as provided in subsection (2), a railroad shall not operate a train or locomotive engine engaged in transporting freight unless the train or locomotive engine is operated by a crew of not fewer than 2 individuals.

(2) Subsection (1) does not apply under either of the following circumstances:

(a) Operating a locomotive engine in hostler service.

(b) Operating a locomotive engine in helper service.

(3) As used in this section:

(a) "Helper service" means assisting a train that is experiencing a mechanical failure or that is ascending or descending a grade by coupling a locomotive engine to the front or rear of the train.

(b) "Hostler service" means moving a train or locomotive engine a short distance within a railroad yard or mechanical facility.

(c) "Train" means 1 or more locomotive engines, coupled with or without cars, that are required to undergo air brake testing under 49 CFR 232.
