A bill to amend 1911 PA 209, entitled
"An act to adopt and prescribe the design of a state coat-of-arms
and state flag, and their use; to prohibit the use of the same for
advertising purposes; to prescribe standards for the manufacture,
sale, and display of certain flags of the United States and the
state flag; and to prescribe the powers and duties of certain state
agencies and officials,"
by amending the title and section 2a (MCL 2.22a), the title as
amended and section 2a as added by 2012 PA 167.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
TITLE
An act to adopt and prescribe the design of a state coat-of-
arms and state flag, and their use; to prohibit the use of the same
for advertising purposes; to prescribe standards for the purchase,
manufacture, sale, and display of certain flags of the United
States and the state flag; and to prescribe the powers and duties
of certain state agencies, local units of government, and certain
state and local officials.
Sec. 2a. (1) This state, including all branches, departments,
offices, boards, commissions, authorities, or other agencies of
this state, shall not purchase a flag of the United States or a
state flag of Michigan for display upon a building or property
owned, or entirely leased, or operated by this state, including all
branches, departments, offices, boards, commissions, authorities,
or other agencies of this state, unless the flag was manufactured
in the United States or a territory of the United States.
(2) This state, including all branches, departments, offices,
boards, commissions, authorities, or other agencies of this state,
shall not purchase a flag of the United States or state flag of
Michigan for resale unless the flag was manufactured in the United
States or a territory of the United States.
(3)
This section does not apply to local units of government.
(3) Beginning January 1, 2014, if a local unit of government
purchases a flag of the United States or a state flag of Michigan,
the local unit of government shall disclose on its internet website
the country in which each flag of the United States or state flag
of Michigan was manufactured. If a local unit of government does
not have an internet website, that local unit of government may
meet the disclosure requirements of this subsection by posting on
the website of the county in which that local unit of government is
located. A local unit of government that discloses information on
its internet website or a website operated by another local unit of
government, as required under this subsection, shall update the
internet website at least once a year.
(4) As used in this section, "local unit of government" means
a county, city, village, township, school district, intermediate
school district, community college district, public library, or
local authority created under state law.
