HOUSE BILL NO. 4683

A bill to amend 1931 PA 328, entitled

"The Michigan penal code,"

(MCL 750.1 to 750.568) by adding section 14a.

the people of the state of michigan enact:

Sec. 14a. (1) A person who willfully administers to any pregnant individual any medicine, drug, substance, or thing whatsoever, or who employs any instrument or other means whatsoever, with the intent to perform an abortion, unless the abortion is necessary to preserve the life of the pregnant individual, is guilty of a felony.

(2) If the abortion results in the death of the pregnant individual, the person is guilty of manslaughter.

(3) In a prosecution under this section, it is not necessary for the prosecution to prove that no such necessity for the abortion existed.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.

Enacting section 2. This amendatory act does not take effect unless Senate Joint Resolution ____ or House Joint Resolution C (request no. 03057'23) of the 102nd Legislature becomes a part of the state constitution of 1963 as provided in section 1 of article XII of the state constitution of 1963.
