HOUSE BILL No. 4572

 

March 12, 2009, Introduced by Reps. Agema, Rick Jones, Walsh, Kowall, Meltzer, Meekhof, Knollenberg, Haines, Rogers, Pearce, Opsommer, Calley, Wayne Schmidt, McMillin, Elsenheimer and Schuitmaker and referred to the Committee on Judiciary.

 

     A bill to amend 1949 PA 300, entitled

 

"Michigan vehicle code,"

 

(MCL 257.1 to 257.923) by adding section 311b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 311b. (1) If a person violates section 543l of the

 

Michigan penal code, 1931 PA 328, MCL 750.543l, and the violation

 

is a cause of the department improperly issuing a license to

 

operate a motor vehicle to an individual who is in this country

 

illegally, the department may recover the greater of the following

 

from the person or from the individual who is in this country

 

illegally, or from both the person and the individual who is in

 

this country illegally:

 

     (a) The actual and reasonable costs incurred by the department

 


as a result of the violation, including correcting the records of

 

the department.

 

     (b) $1,000.00.

 

     (2) If more than 1 person or individual is responsible for

 

paying costs under this section, the court may order the amount

 

required to be paid under this section to be divided among those

 

persons and individuals.

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No. 4573(request no.

 

02029'09) of the 95th Legislature is enacted into law.
