A bill to amend 1984 PA 218, entitled
"Third party administrator act,"
(MCL 550.901 to 550.960) by adding section 33.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 33. A third party administrator shall not enter into a
service contract for a benefit plan that provides coverage for
first assistant at surgery services when the first assistant at
surgery services are rendered by a licensed health professional
other than a physician unless that benefit plan also includes
coverage for first assistant at surgery services rendered by a
registered professional nurse who is acting as a registered nurse
first assistant within the scope of his or her license or specialty
certification and payment for those services is made on an
equitable basis. Payments to registered professional nurses who are
acting as registered nurse first assistants for first assistant at
surgery services under the benefit plan may be subject to the same
credentialing and contracting requirements that apply to other
licensed health professionals paid for first assistant at surgery
services.
Enacting section 1. This amendatory act applies to a service
contract entered into after the effective date of this amendatory
act. For a service contract in effect on or before the effective
date of this amendatory act, this amendatory act applies on the
date the service contract is next extended, renewed, or modified in
any manner.
Enacting section 2. This amendatory act does not take effect
unless all of the following bills of the 97th Legislature are
enacted into law:
(a) Senate Bill No.____ or House Bill No. 4522(request no.

(b) Senate Bill No.____ or House Bill No. 4521(request no.
00756'13).
