HOUSE BILL NO. 4431

A bill to amend 1931 PA 328, entitled

"The Michigan penal code,"

by amending sections 158 and 159 (MCL 750.158 and 750.159).

the people of the state of michigan enact:

CHAPTER XXV

CRIME AGAINST NATURE OR SODOMY BESTIALITY

Sec. 158. Any person An individual who shall commit the abominable and detestable crime against nature either with mankind or with any animal shall be commits bestiality is guilty of a felony, punishable by imprisonment in the state prison for not more than 15 years, or if such person the individual was at the time of the said offense a sexually delinquent person , may be at the time the individual committed bestiality, the individual is guilty of a felony punishable by imprisonment in the state prison for an indeterminate term, the minimum of which shall must be not less than 1 day and the maximum of which shall be is life.

Sec. 159. In any prosecution for sodomy, it shall not be bestiality, it is not necessary to prove emission, and any sexual penetration, however slight, shall be deemed is sufficient to complete the crime specified in the next preceding section .158.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
