HOUSE BILL NO. 4374

A bill to amend 1936 (Ex Sess) PA 1, entitled

"Michigan employment security act,"

(MCL 421.1 to 421.75) by adding section 32e.

the people of the state of michigan enact:

Sec. 32e. (1) Notwithstanding any other provision of this act, the unemployment agency shall provide to an administrative law judge who conducts a hearing under this act all of the following items that are in the unemployment agency's possession and that relate to the matter before the administrative law judge:

(a) All correspondence between the unemployment agency and the interested parties, including, but not limited to, letters, determinations, redeterminations, and recordings of telephone calls.

(b) The original application for benefits submitted by the claimant.

(c) All amended applications for benefits submitted by the claimant.

(d) All information submitted by the claimant to verify the claimant's identity.

(2) Subsection (1) does not prohibit the unemployment agency from providing to an administrative law judge who conducts a hearing under this act an item not listed in subsection (1) that is related to the matter before the administrative law judge. If the unemployment agency violates subsection (1), the administrative law judge who conducts the hearing shall immediately notify the unemployment insurance advocate of the violation.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No. _____ or House Bill No. 4372 (request no. 00188'23) of the 102nd Legislature is enacted into law.
