      A bill to amend 1976 PA 388, entitled

 

"Michigan campaign finance act,"

 

(MCL 169.201 to 169.282) by adding section 48.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

 1        Sec. 48. (1) An automated telephonic communication to an

 

 2  elector that relates to an election, a candidate, or ballot

 

 3  question must clearly state the name of the person paying for the

 

 4  communication.

 

 5        (2) If the communication described in subsection (1) relates

 

 6  to a candidate and is an independent expenditure not authorized in

 

 7  writing by that candidate's candidate committee, the communication

 

 8  must also clearly state the following disclaimer: "Not authorized

 

 9  by any candidate committee". If the communication described in

 

10  subsection (1) relates to a candidate and is not an independent

 


 1  expenditure, but is paid for by a person other than the candidate

 

 2  to whom it is related, the communication must also clearly state

 

 3  the following disclaimer:

  "Authorized by ___________________________________________".

           (name of candidate or name of candidate committee)

 

 

 6        (3) A communication described in subsection (1) must clearly

 

 7  state the name of the person paying for the communication and any

 

 8  disclaimers required under subsection (2) at the beginning of the

 

 9  communication.

 

10        (4) A person who knowingly violates this section is subject to

 

11  a civil fine of not more than $1,000.00 for each violation.
