HOUSE BILL No. 4031

     A bill to amend 1939 PA 280, entitled

 

"The social welfare act,"

 

(MCL 400.1 to 400.119b) by adding section 109n.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 109n. (1) The department of community health shall not

 

pay for an investigational drug under the medical assistance

 

program administered under this act that requires a special

 

appropriation.

 

     (2) As used in this section, "investigational drug" means a

 

drug that has successfully completed phase 1 of a clinical trial

 

but has not yet been approved for general use by the United States

 

Food and Drug Administration and remains under investigation in a

 

United States Food and Drug Administration-approved clinical trial.
