A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1136.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1136. (1) This section may be known as the privacy in
student course work and test-taking law.
(2) The board of a school district or intermediate school
district or board of directors of a public school academy shall
ensure that the school district, intermediate school district, or
public school academy complies with all of the following concerning
curriculum, pupil testing, and pupil privacy:
(a) Does not administer to a pupil any assessment or test that
requests a pupil to disclose any of the following information
concerning the pupil:
(i) Socioeconomic data or personally identifiable information
other than the pupil's name or student identification number.
(ii) Place of birth.
(iii) Political affiliations or beliefs of the pupil or of a
pupil's family member.
(iv) Religious practices, affiliations, or beliefs of the pupil
or of a pupil's family member.
(v) Income or family income, unless required by law to
determine eligibility for participation in a program or for
receiving financial assistance under a program.
(vi) Any other information concerning the pupil's
relationships, health, behaviors, attitudes, or beliefs, or those
of a family member, unless approved in writing by the pupil's
parent or legal guardian.
(b) Does not collect or use any biometric data concerning a
pupil during an assessment or test or any other school-related
activity.
(c) Does not collect or use any type of physiological response
data from a biofeedback apparatus that would measure a pupil's
blood volume, pulse, or galvanic skin response during an assessment
or test or any other school activity.
(d) Does not use any facial recognition technology or any
device intended to measure a child's behavioral responses during an
assessment or test or any other school-related activity.
(e) Does not disclose to any agency of the federal government,
to the state board, or to any other outside entity any information
contained in a student record that would reveal any of the
information listed in subdivision (a)(i) to (vi) or any student
photographs.
(3) This section does not prohibit the production or local
school use of a photograph or video of a pupil for a legitimate
educational purpose, such as a parentally approved student
identification card, yearbook photograph, or extracurricular
activity photograph.
