An Act relative to Farmers' Markets.
��������������� Be
it enacted by the Senate and House of Representatives in General Court
assembled, and by the authority of the same, as follows:
SECTION 1.� Section 17B of chapter 130 of the general laws, as appearing in the 2006 official edition, is hereby amended by inserting, at the end thereof the following:-
�; provided further that the holder of a propagation permit, so-called, shall not be required to possess a commercial permit as provided by section 80 and shall further be allowed to sell shellfish grown under such permit at a farmers market registered by the department of agricultural resources�
SECTION 2.� Section 80 of said chapter 130, as so appearing, is hereby amended, in line 14, by inserting after the words �shellfish or marine worms� the following:-
�or unless he is the holder of an aquaculture propagation permit as provided in section 17B�.
SECTION 3.� Said section 80 of said chapter 130, as so appearing, is hereby amended, in line 28, by inserting after the words �shall be exempt from obtaining a wholesale dealer permit;� the following:-
� ;and provided further that the holder of an aquaculture propagation permit as provided by section 17B shall be exempt from obtaining a wholesale dealer permit;�
SECTION 4.� Said section 80 of said chapter 130, as so appearing, is hereby further amended, in line 36, by inserting after the words �named on the permit;� the following:-
�;provided further that the holder of an aquaculture propagation permit as provided by section 17B shall be permitted to sell shellfish grown under such permit at a farmers market that is registered by the department of agricultural resources;�
