An Act to Improve Recycling Rates in the Commonwealth Through the Convenient Location of Receptacles.



                Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1: Chapter 94: Section 309. License; necessity; application; issuance; display; fees be amended as follows:

When such vending machines contain beverages sold in any beverage container as defined Chapter 94: Section 321, the applicant for said license as described in Section 309 shall cause the placement of a receptacle of suitable size and material as determined by the commissioner of administration under the provision of section three B of chapter seven. This receptacle shall be clearly indicated as for “recycling of beverage containers”.

 

The licensee shall cause the recyclable contents of this receptacle to be transferred to appropriate recycling facilities and done so with adequate frequency that contents of said receptacle do not protrude above the highest point on said receptacle.

 

Said receptacle shall be located within no more than ten feet of the vending machine(s). In the case that there are multiple vending machines, said receptacle may be located ten feet from the closest vending machine in the group.

 

Failure to place said receptacle as described herein shall cause the revocation of the permit to operate said vending machine. In the event that the receptacle’s composition, placement, or size are determined by other regulations and or statutes, making placement impossible, the license to operate the vending machine must be revoked.
