RESOLVE


Resolved,

That a special commission be established for the purpose of making an investigation into the implementation of MGL C.40B by the Department of Housing and Community Development.  Said commission shall review all policies and procedures to ensure a fair and equitable implementation of the law.  The commission shall make recommendations that will further the creation of affordable housing in the Commonwealth, while enabling cities and towns to maintain greater local control of the development of low and moderate income housing built under a comprehensive permit, and further, preventing the abuses by developers as described in the reports of the Inspector General  based on his investigations which began in 2006.

That special commission shall consist of three members of the Senate; three members of the House of Representatives;  one representative from the Office of the Inspector General; and two members appointed by the Governor.

Said commission shall report to the General Court the results of its investigation and its recommendations by filing the same with the Clerk of the Senate and the Clerk of the House of Representatives on or before the last Wednesday of June 2009.
