Summary
Create new sections of KRS Chapter 365 to define "business," "collects," "consumer," "personal information," "sale," and "verified request"; require notices to be accessible to consumers; establish notice requirements; establish the ability to remedy a failure to comply; provide consumers the right to opt out via a verified request and the process of fulfilling the verified request; require Web sites and online services to provide an opt-out notice to consumers and establish the requirements for this notice; provide an exception for Web sites specific to Kentucky residents; provide protections for minors regarding the sale of their personal information and the right to opt-in; prohibit businesses from discriminating against consumers who choose to opt-out; provide the Attorney General the authority to enforce this Act; establish civil penalties for violations.
