SENATE RESOLUTION



MADAM PRESIDENT:

    I offer the following resolution and move its adoption:

    A SENATE RESOLUTION urging the Legislative Council to assign to an interim study committee the topics of the criminal law of competency to stand trial and insanity.

    Whereas, The court procedure to consider the mental competency of an individual to stand trial and the use of insanity as a defense are addressed in IC 35-36;

    Whereas, There is continued concern regarding the availability of qualified individuals to evaluate defendants on these grounds;

    Whereas, There are no unified standards for the psychological evaluation of defendants; and

    Whereas, There are delays in making these determinations and in the placement of individuals determined to be incompetent to stand trial: Therefore,

Be it resolved by the Senate of the

General Assembly of the State of Indiana:


    SECTION 1. That the Indiana Senate urges the Legislative Council to assign to an interim study committee the topics of the criminal law defenses of competency to stand trial and insanity.
