A SENATE RESOLUTION urging the Legislative Council to
assign to the Interim Sentencing Policy Committee or the
Commission on Courts the study of ways to improve the
retention of evidence in criminal cases.

MADAM PRESIDENT:
I offer the following resolution and move its adoption:
A SENATE RESOLUTION urging the Legislative Council
to assign to the Interim Sentencing Policy Committee or the
Commission on Courts the study of ways to improve the
retention of evidence in criminal cases.
Whereas, The handling and preservation of evidence in
criminal cases, particularly biologically testable evidence, is
of the upmost importance to the state of Indiana;
Whereas, If evidence is not preserved, the state of
Indiana may lose the ability to effectively prosecute cold
cases, or re-prosecute cases that are reversed years after
conviction;
Whereas, More statutory guidance may be needed on the
retention of evidence in criminal cases; and
Whereas, It is prudent to study ways to improve the
retention of evidence in criminal cases: Therefore,
SECTION 1. The Legislative Council is urged to assign to the Interim Sentencing Policy Committee or the Commission on Courts the study of ways to improve the retention of evidence in criminal cases.
SECTION 2. The Commission shall present its findings and recommendations in a final report when directed to do so by the Legislative Council.
SECTION 3. The Secretary of the Senate is hereby directed to transmit a copy of this Resolution to the Legislative Council through the Executive Director of the Legislative Services Agency.
