Synopsis: Reporting of federal receipts and expenditures. Requires each state agency and political subdivision to report to the budget agency before November 1 of each year its total federal receipts, the percentage of its annual budget comprised by federal receipts, and its contingency plan if federal receipts are diminished. Requires the budget agency to submit, before December 1 each year, a report to the house ways and means committee and the senate appropriations committee that compiles and summarizes the reports the budget agency receives. Requires the chair of the house ways and means committee and the chair of the senate appropriations committee to place the report on the next committee agenda.

SENATE BILL No. 332



    A BILL FOR AN ACT to amend the Indiana Code concerning state and local administration.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 4-12-15; (12)IN0332.1.1. -->     SECTION 1. IC 4-12-15 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2012]:
     Chapter 15. Federal Receipts Reporting Requirements Act
    Sec. 1. This chapter may be cited as the Federal Receipts Reporting Requirements Act.
    Sec. 2. As used in this chapter, "designated state agency" means a state agency, as defined in IC 4-13-1-1.
    Sec. 3. As used in this chapter, "federal receipts" means federal financial assistance, as defined in 31 U.S.C. 7501, that is reported as part of a single audit.
    Sec. 4. As used in this chapter, "political subdivision" has the meaning set forth in IC 36-1-2-13.
    Sec. 5. As used in this chapter, "single audit" has the meaning set forth in 31 U.S.C. 7501.
    Sec. 6. (a) Each designated state agency and each political subdivision shall prepare a report each year that includes the

following:
        (1) The total value of federal receipts the designated state agency or political subdivision received for the preceding fiscal year.
        (2) The total amount of federal funds appropriated by the state to the designated state agency or political subdivision for the preceding state fiscal year.
        (3) The percentage of the total budget for the designated state agency or political subdivision that constitutes federal receipts received for that state fiscal year.
        (4) A plan for operating the designated state agency or political subdivision:
            (A) if there is a reduction of five percent (5%) or more in the federal receipts that the designated state agency or political subdivision receives; and
            (B) if there is a reduction of twenty-five percent (25%) or more in the federal receipts that the designated state agency or political subdivision receives.
    (b) Before November 1 of each year, each designated state agency and political subdivision shall submit its report to the budget agency in an electronic format as prescribed by the budget agency.
    Sec. 7. (a) The budget agency shall prepare a report each year that:
        (1) compiles and summarizes the reports the budget agency receives under section 6 of this chapter; and
        (2) compares the total value of federal receipts each designated state agency and political subdivision received for the previous state fiscal year to the total budget of the designated state agency or political subdivision for that state fiscal year.
    (b) The budget agency shall, as part of the report required by this section, compile a list of designated state agencies and political subdivisions that do not submit a report as required by section 6 of this chapter.
    (c) Before December 1 of each year, the budget agency shall submit the report required by this section to the executive director of the legislative services agency in an electronic format under IC 5-14-6 for distribution to the members of the house ways and means committee and the senate appropriations committee.
    Sec. 8. Upon receipt of the report required by section 7 of this chapter, the chair of the house ways and means committee and the

chair of the senate appropriations committee shall place the report on the agenda for review and consideration at the committee's next meeting. When considering the report, the committee may elect to:
        (1) recommend that the general assembly reduce or eliminate appropriations for a designated state agency or political subdivision;
        (2) take no action; or
        (3) take another action that a majority of the committee approves.
