Synopsis: Retail sales of Tannerite. Regulates the retail sale of Tannerite, a patented ammonium nitrate and aluminum powder based binary explosive used primarily as a target for firearms practice. Provides that a retailer: (1) must secure Tannerite behind a counter or in a locked display case so that Tannerite is unavailable to a customer without the assistance of the retailer or an employee of the retailer; (2) may not sell Tannerite to a customer who is less than 18 years of age; and (3) must verify the age of a customer who wishes to purchase Tannerite by requiring the customer to produce a valid government issued photographic identification card that shows the date of birth of the customer. Makes it a Class C infraction for a person to violate the law concerning the retail sale of Tannerite.

    A BILL FOR AN ACT to amend the Indiana Code concerning trade regulation.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 24-4-19; (13)IN0262.1.1. -->     SECTION 1. IC 24-4-19 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]:
     Chapter 19. Tannerite Sales
    Sec. 1. As used in this chapter, "binary explosive" means an explosive that consists of two (2) components, neither of which is explosive by itself, that must be mixed together to become explosive.
    Sec. 2. As used in this chapter, "retailer" means a person who sells or otherwise distributes Tannerite for consideration to an end user in Indiana.
    Sec. 3. As used in this chapter, "Tannerite" means a patented ammonium nitrate and aluminum powder based binary explosive used primarily as a target for firearms practice.
    Sec. 4. A retailer must secure Tannerite:
        (1) behind a counter; or
        (2) in a locked display case;
so that Tannerite is unavailable to a customer without the assistance of the retailer or an employee of the retailer.
    Sec. 5. (a) A retailer may not sell Tannerite to a customer who is less than eighteen (18) years of age.
    (b) Before a retailer sells Tannerite to a customer, the retailer must verify the age of the customer by requiring the customer to produce a valid government issued photographic identification card that shows the date of birth of the customer.
    Sec. 6. A person who violates this chapter commits a Class C infraction.
