SENATE BILL No. 242



    A BILL FOR AN ACT to amend the Indiana Code concerning state and local administration.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 4-6-15; (12)IN0242.1.1. -->     SECTION 1. IC 4-6-15 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2012]:
     Chapter 15. Protection Order Card Program
    Sec. 1. As used in this chapter, "protected person" means a petitioner who is protected by the terms of a protection order, or a family member or household member of the petitioner.
    Sec. 2. As used in this chapter, "protection order" has the meaning set forth in IC 34-6-2-121.6. The term includes a foreign protection order (as defined in IC 34-6-2-48.5) that is substantially similar to a protection order described in IC 34-6-2-121.6.

     Sec. 3. As used in this chapter, "protection order card" means a plastic or laminated wallet sized card that contains information relating to a protection order, including information that relates to the protected person and the respondent.
    Sec. 4. As used in this chapter, "respondent" means the individual against whom the enforcement of a protection order is

sought.
    Sec. 5. The attorney general may establish a protection order card program to issue a protection order card to a protected person.
    Sec. 6. (a) The front of a protection order card issued under this chapter must include the respondent's:
        (1) photograph;
        (2) name;
        (3) date of birth;
        (4) sex;
        (5) race;
        (6) eye color;
        (7) hair color;
        (8) height;
        (9) weight;
        (10) distinguishing features, such as scars or tattoos; and
        (11) any other relevant information as determined by the attorney general.
    (b) The reverse of the card must include:
        (1) the protected person's:
            (A) name;
            (B) birth date;
            (C) sex;
            (D) race; and
            (E) height;
        (2) the cause number listed on the protection order;
        (3) the issuing court and county for the protection order;
        (4) the date the protection order was issued;
        (5) the expiration date of the protection order, if any; and
        (6) any other relevant information as determined by the attorney general.
    Sec. 7. The attorney general shall permit a protected person to apply for a protection order card:
        (1) electronically through the attorney general's Internet web site; and
        (2) by United States mail.
    Sec. 8. The attorney general shall enter into an agreement or memorandum of understanding with appropriate persons in each county, if necessary, to ensure that the protection order card program is available to residents of every county in Indiana. The attorney general shall take steps to publicize the program in each county.


    Sec. 9. The attorney general may accept a grant or donation to operate the protection order card program.
    Sec. 10. The attorney general may adopt rules under IC 4-22-2 to implement this chapter.
