Synopsis: Expedited EMS certification for military spouse. Provides that the emergency medical services commission (commission) shall issue a license or certificate to a military spouse who meets certain requirements. Allows the commission to issue a temporary practice certificate or provisional license while the military spouse is satisfying certain requirements as determined by the commission.

    A BILL FOR AN ACT to amend the Indiana Code concerning health.

Be it enacted by the General Assembly of the State of Indiana:

     Chapter 11. Licensure of Military Spouses
    Sec. 1. As used in this chapter, "military spouse" means the husband or wife of an individual who is a member of the armed forces of the United States.
    Sec. 2. Notwithstanding any other provision of this article, the commission shall issue a license or certificate to a military spouse to allow the military spouse to provide emergency medical services in Indiana if, upon application to the commission, the military spouse satisfies the following conditions:
        (1) Holds a current license or certification from another jurisdiction, and that jurisdiction's requirements for the license or certificate are substantially equivalent to or exceed the requirements for the license or certificate the applicant is seeking from the commission.
        (2) Can demonstrate competency in emergency medical services through methods determined by the commission, including having completed continuing education units or having had recent experience for at least two (2) of the five (5) years preceding the date of the application under this section.
        (3) Has not committed any act in any jurisdiction that would have constituted grounds for refusal, suspension, or revocation of a license or certificate to provide emergency medical services in Indiana at the time the act was committed.
        (4) Is in good standing and has not been disciplined by the agency that has jurisdiction to issue the license or certification.
        (5) Pays any fees required by the commission under IC 16-31-3-13.5 for the license or certificate the applicant is seeking from the commission.
    Sec. 3. All relevant experience of a military spouse, including full-time and part-time experience, regardless of whether in a paid or volunteer capacity, must be credited in the calculation of the number of years the military spouse has provided emergency medical services for purposes of section 2 of this chapter.
    Sec. 4. A nonresident who is issued a license or certificate under this chapter is entitled to the same rights and is subject to the same obligations as required of a resident who is issued a license or certificate by the commission.
    Sec. 5. (a) Notwithstanding any other provision of this article, the commission may issue a temporary practice certificate or provisional license to a military spouse who is licensed or certified in another jurisdiction while the military spouse is satisfying certain requirements, as determined by the commission, for a license or certificate under section 2 of this chapter.
    (b) The military spouse may practice under a temporary practice certificate or provisional license issued under subsection (a) until:
        (1) a license or certification is granted or denied by the commission;
        (2) the temporary certificate expires; or
        (3) the military spouse fails to comply with the terms of the

temporary practice certificate or provisional license.
    Sec. 6. The commission may adopt rules under IC 4-22-2 necessary to implement this chapter.
    Sec. 7. This chapter does not prohibit a military spouse from proceeding under the licensure or certification requirements established by the commission under the other provisions of this article.
