funding strategies for state and local roads in Indiana.

A BILL FOR AN ACT concerning transportation.
(b) The commission on state and local road funding is established to:
(1) examine existing sources of state and local road funding;
(2) examine existing and historical distribution and appropriation levels for state and local road funding;
(3) identify funding needs for state and local roads;
(4) evaluate alternative strategies to replace or supplement the motor carrier fuel tax imposed under IC 6-6-4.1;
(5) study and recommend alternative funding sources and revenue collection systems, including user and nonuser fees;
(6) study and develop strategies to maximize public awareness of the benefits of investments in transportation; and
(7) support economic activity and personal mobility in Indiana.
(c) The commission consists of the following members, all of
whom are voting members:
(1) Fifteen (15) members shall be appointed by the governor
as follows:
(A) One (1) member with expertise in commerce.
(B) One (1) member with expertise in public finance.
(C) One (1) member representing the general public.
(D) The member nominated by the Indiana chapter of the
American Concrete Pavement Association.
(E) The member nominated by the American Council of
Engineering Companies.
(F) The member nominated by the Asphalt Pavement
Association of Indiana.
(G) The member nominated by the Association of Indiana
Counties.
(H) The member nominated by the Indiana Association of
Cities and Towns.
(I) The member nominated by the Indiana Chamber of
Commerce.
(J) The member nominated by the Indiana Construction
Association.
(K) The member nominated by the Indiana department of
transportation.
(L) The member nominated by the Indiana Farm Bureau.
(M) The member nominated by the Indiana Metropolitan
Planning Organization Council.
(N) The member nominated by the Indiana Motor Truck
Association.
(O) The member nominated by the Indiana State Building
& Construction Trades Council.
(2) Four (4) members of the senate shall be appointed as
follows:
(A) The chairperson of the senate standing committee
having primary responsibility for transportation matters,
as determined by the president pro tempore of the senate,
or another member of the senate designated by the
president pro tempore of the senate.
(B) The ranking minority member of the senate standing
committee having primary responsibility for
transportation matters, as determined by the minority
leader of the senate, or another member of the senate
designated by the minority leader of the senate.
(C) The chairperson of the senate standing committee
considering issues of finance, as determined by the
president pro tempore of the senate, or another member of
the senate designated by the president pro tempore of the
senate.
(D) The ranking minority member of the senate standing
committee considering issues of finance, as determined by
the president pro tempore of the senate, or another
member of the senate designated by the minority leader of
the senate.
(3) Four (4) members of the house of representatives shall be
appointed as follows:
(A) The chairperson of the house standing committee
having primary responsibility for transportation matters,
as determined by the speaker of the house of
representatives, or another member of the house of
representatives designated by the speaker of the house of
representatives.
(B) The ranking minority member of the house standing
committee having primary responsibility for
transportation matters, as determined by the minority
leader of the house of representatives, or another member
of the house of representatives designated by the minority
leader of the house of representatives.
(C) The chairperson of the house committee on ways and
means or another member of the house of representatives
designated by the speaker of the house of representatives.
(D) The ranking minority member of the house committee
on ways and means or another member of the house of
representatives designated by the minority leader of the
house of representatives.
(4) One (1) member with expertise in manufacturing shall be
appointed by the president pro tempore of the senate in
consultation with the minority leader of the senate.
(5) One (1) member with expertise in labor shall be appointed
by the speaker of the house of representatives in consultation
with the minority leader of the house of representatives.
(d) The member appointed under subsection (c)(3)(A) shall act
as chairperson of the first meeting of the commission, at which the
commission shall elect from its legislative members a chairperson
to serve for the duration of the commission.
(e) The commission shall meet throughout the year on the call
of the chairperson.
(f) The commission shall report findings and make recommendations to the governor and to the legislative council in an electronic format under IC 5-14-6 as follows:
(1) A report not later than November 1, 2010, that includes the following:
(A) Capital and maintenance needs identified by the commission.
(B) Identification of local road agencies and their funding sources and responsibilities.
(C) Analysis of relative use of state and local highway and road systems.
(D) Alternative transportation funding sources.
(E) Historical transportation funding patterns and their relationship to state fiscal resources.
(F) Strategies to maximize public awareness of the benefits of investments in transportation.
Any part of the report that relates to highways must include the functional and legal classifications of the highway.
(2) A final report not later than November 1, 2011, that includes the following:
(A) Any necessary revisions of findings or recommendations made in the November 1, 2010, report.
(B) Suggested changes to:
(i) transportation funding sources and calculations; and
(ii) transportation planning responsibilities at the state and local levels.
(C) Any minority or individual reports that a member asks to include in the final report.
A report under either subdivision may include recommendations to conduct pilot programs concerning the implementation of other recommendations in the report.
(g) The following shall provide staff support to the commission:
(1) The Indiana department of transportation.
(2) The legislative services agency.
(3) The Indiana local technical assistance program at Purdue University.
(h) Except as otherwise provided in this SECTION, the commission shall operate under the policies governing study committees adopted by the legislative council.
(i) This SECTION expires December 31, 2011.
